Harmful Content for Minors

Instagram exposes minors to harmful content, including misogynistic and hyper-conservative ideologies, reinforcing restrictive gender roles and contributing to psychological harm. Studies also link Instagram to facilitating networks that promote child sexual abuse material (CSAM). Meta's algorithms not only enable these networks to flourish, but actually promote them. Furthermore, minors are subjected to excessive and intrusive data collection practices for profiling and targeted advertising, often without valid consent, which violates legal requirements for the protection of children's data.

“Pay or Okay” Consent

Meta's “Pay or Okay” consent model forces users to either agree to extensive processing of their personal data for targeted advertising or pay a monthly fee to avoid it, thereby failing to offer a genuine, voluntary choice. This approach to consent does not meet the requirements of the GDPR, as the GDPR requires consent to be voluntary, specific, informed, and unambiguous. The model puts pressure on users, rendering consent obtained in this way invalid, while access to alternatives such as less personalized ads is made unnecessarily complex. Furthermore, Meta does not offer a simple way to refuse data processing in the context of personalized ads, unless one takes out a paid subscription, which is a violation of users' right to privacy.

AI Training 

In April 2025, Meta announced that it will use EU personal data from Instagram and Facebook users to train its new AI systems, unless the user objects to this before May 27, 2025. This practice is illegal because Meta does not obtain valid, informed consent for the processing of personal data, but instead wrongfully relies on “legitimate interest” as the legal basis. In the Netherlands, the Amsterdam District Court has therefore prohibited the use of personal data in the context of training Meta's AI systems. The processing is insufficiently transparent, and Meta's complex objection options hinder users' ability to effectively exercise control over their data. Furthermore, Meta shares a large amount of personal data between its various platforms to train AI without a clear legal basis, which violates the requirements of the GDPR and the guidelines of the European Data Protection Board.
